Terms of Service

 

This agreement governs your use of services provided by Creative Vision Information Technology (“We,” “Us,” or “Our”). By using our services, you agree to these terms.

 

A. Service Provision

 

  1. Grant of Service: We agree to provide the Hosting Services (Reseller, VPS, etc.) as described in the plan selected by the Customer (“You”) for the agreed-upon fees.
  2. Service Modifications: We reserve the right to modify, change, or discontinue any aspect of the Services at any time. We will provide reasonable notice for any material changes.
  3. Customer Responsibility: You are solely responsible for all content stored and transmitted under your account, maintaining the security of your login credentials, and for the security of your scripts and applications.

 

B. Payment, Billing, and Refunds

 

  1. Payment: All services are billed in advance. Services will be provisioned only upon successful payment.
  2. Cancellations and Refunds: Cancellations are governed by our separate Refund Policy, which is incorporated herein by reference.
  3. Non-Payment: Failure to pay recurring fees may result in the suspension and eventual termination of your service and the deletion of your data.

 

C. Limitation of Liability

 

  1. Disclaimer of Warranties: Services are provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including fitness for a particular purpose.
  2. Limitation of Damages: Our liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the Services during the three (3) month period prior to the date of the claim. We will not be liable for any indirect, incidental, or consequential damages, including loss of data or loss of profit.
